Polemik Putusan PN Jaksel Tunda Pemilu, Wamenkumham: Belum Inkrah

SUMAPEDIA.COM, JAKARTA – Wakil Menteri Hukum Dan HAM Edward Omar Sharif Hiariej menyebutkan bahwa putusan Pengadilan Negeri (PN) Jakarta Pusat terkait penundaan Pemilu 2024 belum inkrah atau berkekuatan hukum tetap.

Oleh karena itu, dirinya enggan berkomentar jauh sebelum putusan dianggap inkrah. “Putusan itu belum Inkrah, kalau putusan belum inkrah, maka saya belum bisa berkomentar,” kata Eddy, sapaan akrabnya, di Kantor Kementerian Sekretariat Negara (Kemensetneg), Jakarta, Jumat (3/3/2023).

Menurut Eddy, pemerintah masih menunggu keputusan tersebut di ranah pengadilan sebagai pemegang kekuasaan yudikatif. Sikap pemerintah baru akan diambil, apabila putusan tersebut telah selesai dan berkekuatan hukum tetap.

“Biarkanlah perkara itu berjalan sampai betul-betul sudah mempunyai kekuatan hukum tetap, baru kemudian kami berkomentar,” ujarnya.

Sebelumnya, PN Jakpus memerintahkan Komisi Pemilihan Umum (KPU) untuk menunda penyelenggaraan Pemilu 2024 setelah mengabulkan gugatan Partai Prima. Dalam putusan yang dibacakan pada Kamis (2/3/2023) PN Jakpus memerintahkan KPU menghentikan tahapan pemilu dan mengulang tahapan Pemilu 2024.

Meski demikian, KPU menegaskan akan tetap melanjutkan tahapan Pemilu 2024. Ketua KPU Hasyim Asy’ari akan mengajukan banding ke pengadilan tinggi.

“Kalau sudah kita terima salinan putusan kita akan mengajukan upaya hukum berikutnya yaitu banding ke pengadilan tinggi. Dengan demikian nanti kalau kami sudah bersikap secara resmi dalam arti mengajukan upaya hukum perlu kami tegaskan bahwa KPU tetap akan menjalankan tahapan-tahapan pelaksanaan atau penyelenggaraan pemilu 2024,” kata Hasyim dalam jumpa pers, Kamis (2/3/2023) malam.
