Hasil Sidang Etik: Bharada Richard Eliezer Tak Dipecat dari Polri

Bharada Richard Eliezer atau Bharada E diputuskan tetap dipertahankan sebagai anggota polisi dalam sidang Komisi Kode Etik Polri (KKEP) pada Rabu (22/2/2023) di Jakarta. 

Meski demikian, sidang etik tersebut tetap menyatakan bahwa Bharada E bersalah melakukan tindakan tercela dan diberikan sejumlah sanksi.

“Sesuai Pasal 12 ayat (1) huruf a PP RI Nomor 1 Tahun 2003, maka komisi selaku pejabat yang berwenang memberikan pertimbangan, selanjutnya berpendapat bahwa terduga pelanggar masih dapat dipertahankan untuk tetap berada dalam dinas Polri,” ujar Karopenmas Humas Mabes Polri Brigjen Pol Ahmad Ramadhan di Jakarta pada Rabu (22/2/2023).

Ada sembilan poin yang menjadi pertimbangan dalam pengambilan putusan sidang:

1. Terduga pelanggar belum pernah dihukum karena melakukan pelanggaran, baik disiplin, kode etik, maupun pidana.
2. Terduga pelanggar mengakui kesalahan dan menyesali perbuatannya.
3. Terduga pelanggar telah menjadi justice collaborator atau saksi pelaku yang bekerjasama, di mana pelaku yang lainnya dalam persidangan pidana di PN Jakarta Selatan berusaha mengaburkan fakta peristiwa yang sebenarnya dengan berbagai cara, merusak, menghilangkan barang bukti, dan memanfaatkan pengaruh kekuasaan, tetapi justru kejujuran terduga pelanggar dengan berbagai risiko, telah turut mengungkap fakta yang sebenarnya terjadi.
4. Terduga pelanggar bersikap sopan dan bekerjasama dengan baik selama persidangan, sehingga sidang berjalan lancar dan terbuka.
5. Terduga pelanggar masih berusia muda, masih berumur 24 tahun, masih berpeluang memiliki masa depan yang baik, apalagi dia sudah menyesali perbuatannya serta berjanji tidak akan mengulangi perbuatannya di kemudian hari.
6. Adanya permintaan maaf dari terduga pelanggar kepada keluarga Brigadir Yosua, di mana saat persidangan pidana di PN Jakarta Selatan terduga pelanggar telah mendatangi pihak keluarga Brigadir Yosua, bersimpuh, dan meminta maaf atas perbuatannya yang terpaksa, sehingga keluarga Brigadir Yosua memberikan maaf.
7. Semua tindakan yang dilakukan terduga pelanggar dalam keadaan terpaksa dan karena tidak berani menolak perintah atasan.
8. Terduga pelanggar yang berpangkat bharada atau tamtama Polri tidak berani menolak perintah menembak Brigadir Yosua dari Ferdy Sambo karena selain selaku atasan, jenjang kepangkatan antara terduga pelanggar dengan Ferdy Sambo sangat jauh.
9. Dengan bantuan terduga pelanggar yang mau bekerjasama dan memberikan keterangan yang sejujur-jujurnya sehingga perkara meninggalnya Brigadir Yosua dapat terungkap.

Meski begitu, Eliezer tetap dijatuhi hukuman administratif lantaran terbukti melanggar sanksi etika. “Yaitu perilaku pelanggar dinyatakan perbuatan tercela dan pelanggar wajib meminta maaf secara lisan di hadapan sidang KKEP dan secara tertulis kepada pimpinan Polri,” ujar Brigjen Pol Ramadhan.

“Dan memutuskan sanksi administratif berupa mutasi bersifat demosi selama satu tahun,” tutup Brigjen Pol Ramadhan.
