DIANGGAP MENYERANG KEHORMATAN PRESIDEN DI MUKA UMUM, MEGAWATI BISA DIJERAT PIDANA?

SUMAPEDIA.COM-Ketua Umum Partai Demokrasi Indonesia Perjuangan (PDIP) menegaskan peran penting partainya dalam keberhasilan karir Presiden Joko Widodo. Penegasan itu disampaikan Megawati saat memberi pidato politik dalam peringatan HUT ke-50 PDIP di Jakarta International Expo, Kemayoran, Jakarta, Selasa (10/1/2023).

Dalam pidatonya, Presiden ke-5 RI itu juga membahas soal Presiden Jokowi dan PDIP.

“Pak Jokowi itu ngono lho mentang-mentang, lah iya padahal Pak Jokowi kalau gak ada PDIP kasihan dah,” kata Megawati seraya bertepuk tangan diikuti seluruh kader yang hadir.

Merespons pernyataan Megawati, Jokowi hanya tersenyum.

Menurut Megawati, secara legal formal, Jokowi tidak dapat menjadi presiden.

“Lho legal formal lho, beliau jadi presiden itu gak ada, legal formal diikuti terus sama saya, aturannya, aturan mainnya,” katanya.

Ungkapan ini yang kemudian dinilai kasar dan membuat beberapa pihak keberatan karena dianggap ‘menghina presiden’.

Pasal 218 KUHP

Dalam Undang-Undang Republik Indonesia No.1 Tahun 2023 Tentang Kitab- Undang-Undang Hukum Pidana, Pasal 218 Ayat 1 berbunyi:

“Setiap Orang yang Di Muka Umum menyerang kehormatan atau harkat dan martabat diri Presiden atau Wakil Presiden dipidana dengan pidana penjara paling lama 3 (tiga) tahun 6 (enam) Bulan atau pidana denda paling banyak kategori IV.”

Dilansir dari wawancara Karni Ilyas dengan Wakil Menteri Hukum dan Hak Asasi Manusia, Prof. Omar Sharif Hiariej (2/12/2022). Dijelaskan bahwa pasal 218 KUHP bersifat delik aduan. Dalam hal ini yang berhak mengadukan adalah Pemimpin lembaga Presiden atau Presiden itu sendiri. Demikian juga dengan penghinaan terhadap pemerintah dan lembaga negara seperti MPR RI, DPR RI, DPD RI atau MK, maka yang bisa melaporkan adalah ketua lembaga negara tersebut.

Guru Besar Ilmu Hukum Pidana UGM itu juga menjelaskan, bahwa pasal 218 KUHP dapat digunakan apabila terdapat akibat seperti keonaran atau kerusuhanan. Apabila tidak ada akibat secara fisik maka tidak dapat dipidana.

Pembelaan Puan

Ketua DPR RI Puan Mahari yang juga anak kandung Megawati lantas membela sang Ibu.

Pembelaan itu disampaikan dalam acara Rosi yang ditayangkan Kompas TV.

Bukan menghina atau menyerah harkat dan martabat Presiden Jokowi, Puan menyatakan bahwa sang Ibu sangat menyayangi dan menghormati Jokowi.

“Kalau tahu, Ibu Mega itu sayang banget sama Pak Jokowi, Dn tentu saja hormat sekali sama Pak Jokowi sebagai presiden,” tutur Puan dalam acara Rosi Kompas TV, dikutip (13/1/2023).
